I have set up this up for you to ask questions of your board members or any other items such as security, road maintenance, electric and trash pick up. The questions don't particularly have to be about the aforementioned. You can ask anything you want as long as it about PENCA.

Since November is our annual meeting along with the Mexican meeting and elections I would like to have as many questions answered before the meeting. You questions will be sent to the board for answer and published on here before the meeting.

11/1/11 Question/Comment: On the Agenda, it calls for "service Fee Structure Review. Could you publish the current and proposed fee structure. Also could you publish the "Code of Conduct Agreement, that Mr. Behrens is proposing.

10/28/11 Question/Comment:  There is an item on the agenda (Service Fee Structure Review / Beach Inventory Report).  Could you publish the current service fee structure rules.? Is there going to be a proposed change to the Service Fee Structure presented at the meeting? If so, would you publish the proposed structure so we will have time to consider the proposal before the meeting?

10/25/2011 Question/Comment: I have heard conflicting statements on the HOA fees in regard to owners.  Is it one fee for one lot??  If this is the case, this would then include multiple dwellings on that one lot including condo's, guest houses, etc.  on that one lot. If this is not the case, then all individually standing livable dwellings on a lot would pay a fee for each dwelling since owners and non-owners can occupy at any given time.  Is something in writing for clarification?  It is not in the CCR's.  Thank you.

Answer:  (service fee structure) A “unit” is a home, condo or rental unit. There is no proposed service fee structure change. The review is to clarify and describe at the meeting. This will be posted on the web site soon.

Service Fees are assessed on a per unit basis; counting homes, rental units, condos, individually owned saleable units as single billable units.  Lots are assessed on a per lot basis.

At the November 4, 2006 Homeowners Meeting, PENCA Members voted to begin using a Unit Fee Structure in which Service Fees would be assessed for Services rendered on a per unit basis.  A “Unit” is a home, condo or rental unit.  Each unit would be charged accordingly.  Each lot would be assessed on a per lot basis.

When the Service Fee Structure was initiated in 2007, those properties defined as Rentals under the 2003 Rental Impact Fee, were re-defined as units and charged accordingly on a per unit basis.  Those properties, (guest quarters) in question, that have not been charged and are not charged as units; have been used for personal use only and not used to generate income.

Answer:  The "Code of Conduct Agreement" will be handed out, explained and voted on at the meeting.

10/26/11 Question/Comment: I believe we need some clarification and/or transparency on the answer starting with "As of 10/15/11." Stated are 273 units billed in 2011. Yet additionally stated are 326 database recorded owners. Is is not accurate to deduce that units are paying the fees minus  the fees of the remaining units. In other words, how is it that 326 owners can own "270 lots and 273 units that were billed in 2011?"  This does not make sense unless owners are sharing in on unit/lot ownership. If that is the case, why are not these fees being collected/billed?     Que pasa??

They equate 53 remaining units x  $800 = $42,400 of lost revenue. Poster....how is this arrived at? Please explain.

Answer: Multiple people own more than one unit(s), lot(s) or combination thereof!  Each unit/lot is assessed per year, regardless of the number of properties owned by a single entity. 326 database records (owners) own 270 lots and 273 units that were billed in 2011. Example, John Doe may own one unit and 15 lots. He is billed for one unit and 15 lots. This is the case with several owners owning multiple units and or lots.

10/26/11 Question/Comment: After looking over the number of paid home owners versus unpaid, it seems we have a real problem.  Has the board considered having a meeting and inviting the unpaid members to voice their concerns?   Are they welcome at the HOA meeting?  I believe you must be in good standing to speak. There is potentially a lot of money that might possibly be collected If we could all meet in the middle and try to work this out. 

Answer: Anyone can attend the meetings. The by-laws are very specific concerning who can talk and vote at the meetings “members in good standing”, the board has always offered payment plans and has been willing to work with anyone interested in fulfilling their obligations. The bulk of A/R on the books dates back from 2005 forward.

10/26/11 Question/Comment: Can a listing of the 6 lots as "unknown" owners and the 9 lots that declared bankruptcy become available to be listed and/or emailed to interested parties?

Answer: PENCA does not divulge property owners personal information.

10/26/11 Question/Comment: Seems that some of us are missing screen doors. Any clue on who is doing this? Any Security action being taken?

Answer: From Cristian, we have no clue who is taking the screens away, im sure those screens have been sold as aluminum, for that reason they can fold and break the screens till you get a little piece you can hide anywhere in your car; so far we can only check the cars to see what is inside, but we can not inspect it ( glove box or under the upholstery can be opened by military or police only). somebody told me we need to be out of the law a little bit, but, what happen if we find something illegal? lets say ´´stolen´´ screens (we dont want to find drugs or weapons)...we will notify the police, the police will come, the guy would say he found it in the garbage and until we prove he took those from inside a house nothing will happen but a investigation against us for abuse of authority.

Question/Comment: Have you considered a pay as you go fee to off set the 100+ owners who have not made the effort to pay.  For example,  penca chips could be bought for $50 a piece.  Everytime one visits they would have to give a chip to the guard for the weekend spent.  8 visits a year would merit $400 and 16 would merit $800.  That way everyone would pay!

Question/Comment: The person's) who asked the question about a PENCA chip deserves a more legitimate answer then the one that was given. It does raise a good point. It has been utilized in Hoe's in the USA with a card swiping system with 100% effectiveness.  PENCA chips are simpler and may be what is necessary, fair and eliminate your list of no pays.. much less mailings, trackings, costs,etc... that is reflected here.

Answer: That would cause a riot. 

Answer: The city owns the roads and by Mexican law you cannot deny anyone access.

Answer: While it is an interesting idea, I think this "buy a chip" approach would cause many problems - uncertainty in budgeting, what if someone loses their "chips", forged chips, buying and selling of chips between owners, what if someone doesn't use all their chips, are they refundable or do they carry over to the next year causing more budget uncertainty, etc. 

Answer:  Most HOAs in the US are managed by Management Companies. Who has the diligence and will be willing to spend the time, effort and just plain work to orchestrate and manage an undertaking like this? This is a volunteer organization; with few volunteers.

Question/Comment: Is it possible to drop off trash in THE OLD cage from the burnt truck. I understand why you would not want to repeat another fire BUT, Maybe if the "old cage was strategically placed it would eliminate the need for pickup($$) and be safe at the same time.

Answer: the Cage is available and that garbage can now be dumped in the cage near the entry-gate

10/11/2011 Question/Comment: We read the list of unpaid members.  We counted 108. As paying members, we are interested in knowing how many have paid this year compared to how many have not. 

Answer: As of 10/15/11, we have 320 owners names (do not have current addresses or contact info for some of them but continue to accumulate annual service fee charges) listed in the database and 6 lots as “unknown” owners.

Those 326 database records (referenced above) own 270 lots and 273 units that were billed in 2011.

Of the 270 lots billed, 154 are paid in full and the owner of 9 lots declared bankruptcy in 2011.  We did receive about $550 by filling a claim with the court, but don’t know who the new owner/s is/are for 2012.

Of the 273 units (house, condo, multiplex) billed in 2011, 184 are paid in full and 5 are making payments.  84 units have not paid.

Out of the 326 database records, 211 are paid in full, 5 are making payments and 2 are pending.

Accounts receivable at 10/15/2011 is about $265,000 and at 10/15/2010 it was about $185,500. 

91 of the non-payers for 2011 were also on the list in 2010.

Question/Comment: Are we picking up the trash from homes that are not current on there hoa and if so why?

Answer: As someone who has tried to identify each property, not many properties have visible addresses. It is faster and cleaner if pickup all trash. We have tried to identify paid members by an identifying tile with a sticker with the current year. Many paid members forgot to affix their paid emblem. It’s cleaner for the development to pickup all trash. 

Answer: It is my understanding that we are in order to avoid a huge mess of blowing garbage onto other properties and the beach in general.

Answer: We do pick up because the garbage will blow and the flies would inhabit the area.
