General Meeting

PENCA President Al Ciasca called the meeting to order at 10:03 am. Members were counted with a quorum in attendance. He then thanked Marlene Baker and her family for hosting the meeting and potluck and also thanked her for the nice May baskets she made for all attending the meeting.

Board members were introduced and in attendance were Al Ciasca, President, Terry Creech, Treasurer, Sharon Hill, Secretary. Vocals present were Michael Colpitts, Bert Cooper and Jack Hall. Also present was Marvin Sexson, Architectural Committee Chair.

 

ACTIVITIES OF THE BOARD

1. Enlarging the pond before the March high tides so that more water accumulates for use in watering the roads.

2. A Puerto Penasco police officer was hired over spring break and Easter week. He did a good and professional job and, along with our guards, kept everything under control.

3. The damaged traffic signs have been replaced.

4. Jack Hall, Al Ciasca and the PENCA attorney, Rogelio made a successful trip to Mexicali where they purchased the truck and trailer for garbage collection. The trailer was also customized with sides to hold in the trash that's collected.

5. The addition to the back of the library for housing the PENCA tractor is near completion.

 Minutes of the February 13, 2016 meeting were approved as written by a motion made by Carol Johnson and seconded by Linda Colpitts.

TREASURERS REPORT

PENCA Treasurer, Terry Creech stated that as of March 31, 2016 PENCA assets total$161,512.71. Since January, $129,745.76 has been collected in HOA service fees and miscellaneous income, with expenditures of $47,481.98 leaving a net income of $82,263.78.

Wendell Holder questioned the increase in pay for the guards. Terry Creech responded that their pay was adjusted because of the devaluation of the peso. Marilyn Hall went on to explain that the guards contract had been renegotiated every six months. During that time the peso had been devalued quite a lot. The guards are paid $130 per week. When the dollars were converted to pesos they were getting considerably less. In order to correct this issue the guards contracts are now being negotiated every three months and at that time their pay will be adjusted to the current rate of exchange. Al Ciasca also agreed that their contracts shall be negotiated every three months instead of six.

Roxanne Baker asked why the purchase of the truck and trailer was not on the balance sheet and Terry Creech answered that the information from the bank was not available in the time for the meeting. He said it will be there on the next profit and loss statement under new equipment. Al Ciasca said the truck and trailer cost $6300 and he thanked Jack Hall and Rogelio for their help in negotiating the purchase of the truck and trailer.  

UTILITY PROJECT

Terry Creech reported that, as of March 31, 2016, National Bank had a balance of $132,619.18.Jack Hall said there is a potential problem with one of the Transformers possibly being on someone's personal property and will likely have to be moved. If that is the case, PENCA will have to pay for it. A survey will be done to see if it is on someone's property.

ROADS

Al Ciasca said that the roads are in very good condition, and that Rene is doing an excellent job of maintaining them. He also said that Rene did a great job of increasing the size of the pond.

SECURITY AND TRASH

Al said the guards are doing an excellent job of picking up the trash and that they really like the new equipment. He also said that trash is still an ongoing issue with non-members which prompted a lot of ideas from members on what to do about it. Several people said that they had seen nonmembers putting their trash in the concrete containers in the beach accesses. Marilyn Hall answered that they were put there for people to drop in trash that they pick up on the beach. It was suggested that these containers should have trash liners.

Al also stated, again, that we need to have everyone get trash cans with lids. Carol Johnson, in her best Vanna White impersonation, did a show and tell with a nice trash can, with a lid, that she said was available at Walmart stores for $40. She even offered to bring some down to Playa Encanto if people want to order one.

Marlene Baker questioned as to why we can't charge rentals extra for trash pick up. Al answered that it was a good idea and he would look into it. Michael Colpitts said everyone who is a member should keep their eyes open and tell a board member when they see someone dumping trash who is a non-member.

Al stated that it was decided by the board to increase trash pick up days to Monday, Wednesday and Friday. This will only be in the months from September to June. The summer months will remain on the old schedule of Monday and Friday unless there is a need during a busy time and then the trash will also be picked up on Wednesday.

Jack Garrity said we must urge non-members to stop mooching and that he knows that one of the construction people is picking up non-members trash and dumping it out in the desert east of us. Al said that it was discussed at the board meeting and it was decided to meet with this gentleman and have a discussion with him about it. Carol Johnson said that some of the people in the neighboring communities of Las Portales and Playa Navidad have pictures of some of these offenders dumping trash in their area. Carol said that she would get copies of the pictures to Al. Al suggested that with these pictures that it might be good to meet with someone in Penasco who is in charge of refuse and dumping.

 

ARCHITECTURAL COMMITTEE REPORT

Marv Sexson reported that there are two projects, one is complete and has been refunded their security deposit and the other is close to completion. He stated that there are some lots that have been sold and he expects there will be some new building in the future. He also thanked Dan Freeman for coming on board of the Architectural Committee.

Jo Gupton (PENCA librarian) thanked Marv Sexson, Dan Freeman and Arlen Gupton for making and installing new shelves in the library.

 

OLD BUSINESS

Patsy Pasey inquired about the no bonfire rule in the new set of rules. Al answered that fire pits and chimneys on your own property are fine, just no bonfires out on the beach in the public areas.

Chantai Creech announced that the AED (defibrillator) will be available at the guard shack. She said the guards will be getting a refresher course in CPR within the next couple of months. She is having trouble finding someone that will do the training. The date will be announced on the website for anyone else who would like to attend. Roxanne Baker suggested a CPR demonstration could be done at the November meeting. Chantai said the guards had their last CPR training one and a half years ago. Dave Malinowski wondered if someone from the Penasco Red Cross or local fire department could do the training session. Chantai said she would look into it.

NEW BUSINESS

Wendell Holder questioned why the gate is closed and people are not allowed to drive down to Estero Mauro anymore. Al Ciasca answered that he is aware of the situation and is working on it and will get the attorney involved to resolve the issue if he has to. He also stated that the people at Estero contribute very little to the maintenance of our road which they use. He said six months ago they moved some huge boulders to the area and tons of rocks to protect their homes from high tides and beach erosion. And, of course, the heavy trucks came over our roads and caused more road damage.

Marilyn Hall said that the guards at Esteros gate are taking the brunt of anger from people trying to access the road. She said that the man's name who ordered the road closed is Mark Sweeney. Jack Hall suggested that Marks Sweeney's email address should be on our website so that people can send their concerns directly to him. Tom Jackley asked if Mario Chavez has been informed. Carol Johnson said she was concerned about change in the ocean flow and wondered if a study has been done and since it is in the federal zone do they have a concession to do this? Bert Cooper said that he would email Mario Chavez.

Marilyn Hall said that one of our members wanted to go down to the point to spread their loved ones ashes and they were denied entry. She said she also heard that one of the reasons they closed the road is because of the windsurfers that use the point and leave it a mess. Al said that he would keep the members posted on what is done to resolve this.

Al said that Larry and Sharon Bahns dog was attacked by dogs running loose. The dog’s owner, Marilyn Sheridan, apologized and paid the vet bills and says that the dogs will be chained up. Al said at the board meeting that morning there was a long discussion about how to handle the situation. Al said that he and Michael Colpitts approached Marilyn Sheridan and she assured him that the dogs will not be running loose anymore. Several members stated that since the incident they have seen the dogs running loose so it seems nothing has been done. Al said that it was discussed with the attorney and he said that it's a situation that the Penasco police would have to handle but they would have to be out and catch the dogs running loose in order to do anything about it.

Larry Bahn said that he will have to start carrying a stun gun because these dogs are dangerous. They are two 70 pound boxers. Al said the situation is being addressed and that he intends to call in a policeman to discuss the dog issue with Marilyn Sheridan.

A motion to adjourn was made by Dan Freeman and seconded by Carol Johnson at 11:13 am. A wonderful potluck followed the meeting and a BIG thank you goes out to Marlene Baker and family.
